President Trump, Please Build the Wall Already!

 

President Trump, you have the full support of the people, who elected you in a electoral landslide, to BUILD THE WALL…and, thanks to the United States Constitution, the president, in protecting the borders from unlawful entry, can do all that is necessary unilaterally.

 

Article 2, Section 2: The president is commander in chief of the armed forces. It follows, therefore, that the president is required to defend the borders by any and all means necessary, including, but not limited to, building a wall along the border.

 

The constitution grants this power to the president, and does not afford the federal courts any authority to interfere, in any way:

 

1)   The federal courts lack ANY legislative authority.
Article 1, Section 1: Only the Congress has legislative authority.

 

2)   The federal courts lack ANY authority to overturn legislation
Article 1, Section 7: Only the president can veto a bill.

 

3)   Only the Congress can rescind legislation once passed, and, the federal courts lack ANY authority over the execution of legislation.
Article 2, Section 1: The power to execute legislation exists only in the president.
Article 2, Section 3: Requires the president to faithfully execute all laws.
Article 1, Section7: Once a bill is passed into law it cannot be vetoed, overturned or compromised by the federal courts.

 

4)   The federal courts cannot create rights or change the Constitution in any way:
Article 5: Only the states can change the Constitution.

 

5)   The federal courts lack ANY authority over either the Executive branch or Congress:
Article 3 delineates federal judicial power:
  • There is no mention in the Constitution of ANY federal court authority over legislation, over the powers of Congress or over the powers of the president.
  • There is no mention in the Constitution of “judicial review” by the Supreme Court.
  • The function of the courts is to explain the law as it is written and adjudicate acts as they relate to the law.
  • The Supreme Court’s decisions can neither create law nor overturn law. They can only affect a lower court’s decision as to its interpretation of an act as it relates to existing law.
  • The Supreme Court lacks ANY authority to either interpret the Constitution or the law.

6)   Sanctuary cities are unconstitutional:
Article 1, Section 10: No state shall enter into any …alliance.

7)   The federal courts lack ANY authority to affect immigration law.
Article 1, Section 1: Only the Congress determines the naturalization process.

8)   Only the president has the authority to execute immigration law:
Article 2, Section 1: The president is responsible for the execution of the law.

Most importantly:
9)   The federal government is required to stop unlawful entry into the nation:
Article 4, Section 4: The federal government will protect every state from invasion.

 

 

The bottom line is this:

The president swears the following oath at his swearing-in: “I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.”

President Trump: Ignore the federal courts. They lack any authority over the executive branch. You have sworn an oath to defend the Constitution. You MUST execute the law, protect the borders, terminate sanctuary cities, deport all those having entered the nation unlawfully including all their children, “legalized” or not, as an unlawful act cannot benefit the law breaker in any way.

 

From a purely Constitutional perspective, any acquiescence to federal courts’ rulings that block your attempts to stop this invasion, Mr. President, result in NOT fulfilling your constitutional responsibility.
